Scope and Contents

Transcript consists of fifty pages of legal-size folio manuscript of the Commonwealth case of Commonwealth PA vs Daniel C. Engle and Franklin Grant for conspiracy in poisoning a horse and malicious mischief. This transcript presents the proceedings of the commonwealth's, the defense, and includes numerous annotations in the margin from lawyers, testimony of alleged co-conspirator Herisinger Bushower, the plaintiff’s testimony, testimony from poison and veterinary experts, and witnesses to the race.

The expiration term for corporate, anonymous, or pseudonymous works is 95 years from publication or 120 years from creation, whichever occurs first. For works published before 1978, with a copyright notice, the maximum duration of copyright protection is 75 years. Works published before 1978 without a copyright notice are assumed to be in the public domain. Since March 1, 1989, a copyright notice is no longer necessary. Archives and Special Collections reserves the right to refuse to accept a copying order if fulfillment of the order would involve violation of copyright law.

Biographical / Historical

The poisoning of the match race of Berk County prized horse drew widespread interest and resulted in the conviction of the defendants. The defendants were later pardoned by the PA governor. The poisoned horse was owned by Hiram Shitler in Black Bear, Exeter. Poisoning cases were a popular part of the press in the 1870s.
